PREAMBLE

CALZEDONIA FINANZIARIA DUTCH BRANCH (hereafter: Calzedonia), a company managed and coordinated by Calzedonia Finanziaria S.A., with registered office at Rhijnspoorplein 10-38, 1018 TX Amsterdam. VAT no. NL858552358B01, offers discounts, benefits and services at “Calzedonia” stores (both direct stores and franchises taking part in the promotion) and on the internet site www.calzedonia.com to customers who would like to benefit from them. To take advantage of these benefits you must be a Calzedonia loyalty card holder: the following terms and conditions (hereinafter also “Conditions”) govern the issue and use of the Calzedonia loyalty card (hereinafter the “Card”), which the “Customer Cardholder” should read carefully. The activation of the Card, in accordance with point 6 below, implies that the customer accepts these Conditions.

Calzedonia reserves the right to amend all or part of these terms and conditions from time to time, and these amendments shall enter into effect 10 (ten) days after their publication on www.calzedonia.com. If the “Customer Cardholder” does not accept these amendments, they shall be entitled to cancel their registration, which in any event they shall be entitled to do at any time as set out below.

However, use of the Card, after the amendments have become applicable, shall constitute acceptance, by implication, of the changes applied. Calzedonia also reserves the right to suspend this loyalty program, temporarily or permanently, at any time, without the Customer having any right to complain (subject to any rights already held by the Customer-Holders at that time being upheld), by giving notice on its website at www.calzedonia.com and/or at stores participating in the scheme.
These Conditions can be consulted at all times at www.calzedonia.com.

1. Promoter

CALZEDONIA FINANZIARIA DUTCH BRANCH, a company managed and coordinated by Calzedonia Finanziaria S.A., with registered office at Rhijnspoorplein 10-38, 1018 TX Amsterdam. VAT no. NL858552358B01.

2. PARTICIPANTS

All “Calzedonia” stores, whether these are managed directly by Calzedonia (so-called “direct stores”) or are franchises and, therefore, managed by other businesses (so-called “franchise stores”), which are taking part in the scheme by displaying the associated advertising material and information. The list of stores participating in the scheme can be viewed on the website www.calzedonia.com.

4. TYPE / NAME / PURPOSE OF THE “CALZEDONIA LOVER” LOYALTY PROGRAM / DURATION

This loyalty program is a program that involves collecting points on a card called “Calzedonia Lover” and offering exclusive benefits to holders of said card, according to the purchases made in the points of sale or on the Websites from the countries specified in Article 8.

The aim of the program is to encourage Customer loyalty through a loyalty program that offers advantages to Customers holding a “Calzedonia lover” Card.

Subject to the provisions set out under the Preamble above, under Point 7 (“How it Works”) and Point 10 (“Discontinuation of the scheme – Card Deactivation – Miscellaneous”), the “Calzedonia lover” Card has no expiry date.

5. WHO IS IT INTENDED FOR?

Customers who are at least eighteen years old and hold the Card in accordance with the below conditions relating to scheme registration and operation.

6. HOW TO REGISTER

The Loyalty Program gives the right to a virtual or physical card. The “blank” card may be issued to the Customer in paper form directly at a participating point of or in “digital” form by accessing the website www.calzedonia.com.

Customers shall then “activate” their “Calzedonia lover” Card by registering with the “Calzedonia lover” Loyalty Program on the website www.calzedonia.com or alternatively, they can do so at Calzedonia stores with the help of sales assistants. To register with the “Calzedonia lover” Loyalty Program online, Customers shall create a special account which will enable the customers to access their own personal page on the brand’s e-commerce website.

When registering for the Loyalty Program, the customer is invited to complete his personal data on the membership support. The processing of this personal information is carried out in accordance with the applicable regulations regarding the protection of personal data.

Membership in the Loyalty Program can only be registered in the computer file if the information provided at the time of membership is complete, in the format requested and usable. It is the Customer-holders' responsibility to keep the information about him up-to-date by carrying out the updates on the website www.calzedonia.com. The Company cannot be responsible in case of non-receipt of an offer by the Member due to obsolete or misinformation.

The “blank” card given to the Customer may be used straightaway by linking it with a purchase, but said purchase shall be considered valid for the purchase of earning points only when the card is “activated”: the loyalty program subscription date shall be either the date of the first purchase or the date of registration/activation, whichever is earlier.

The “Calzedonia lover” Card is personal and reserved for private use only; Commercial use shall not be permitted. They cannot be transferred and are in no way a payment card. Each Customer may not activate other Cards while one Card is still valid.

If a Customer’s card is lost or stolen, they should contact any of the “Calzedonia” stores participating in the program to request a replacement: once the customer’s details are checked, the lost/stolen card will be cancelled and the Customer shall receive a new one straightaway, which will allow him/her to recover any loyalty points that had already been earned and not used.

Customers are free to unsubscribe from the “Calzedonia Lover” Loyalty Program at any time, by contacting customer care on 8000234686 or by accessing the website

7. HOW IT WORKS

The Card allows customers to reach 4 different STATUSES by earning loyalty points on their purchases. Customers will receive an increasing level of benefits in accordance with their Status.

“Follower Status”:

This is immediately acquired when the “blank” card is activated/registered.

  • When “Follower Status” customers earn 200 points they move to the following level – “Friend Status”, which will be immediately credited with any points in excess of those used to reach the new status;
  • If a “Follower Status” Customer earns less than 200 points within 365 days of the date they acquire the status, they remain at the “Follower Status” level and their points balance shall be cancelled.
  • If a “Follower Status” customer earns 500 points before they have acquired the “Status Friend”, they move directly to “Status Fan”, which will be immediately credited with any points in excess of those used to reach the new status;
  • If a “Follower Status” customer earns 500 points before they have acquired the “Status Friend”, they move directly to “Status Fan”, which will be immediately credited with any points in excess of those used to reach the new status;
  • If a “Follower Status” customer earns 1,500 points before they have acquired the “Friend” and “Fan” statuses, they move directly to “Lover Status”, which will be immediately credited with any points in excess of those used to reach the new status.

“Friend Status”:

  • Customers acquire this status as soon as they have earned 200 points. The new status which will be immediately credited with any points in excess of those used to move level
  • Once they earn 300 points, “Friend status” Customers move to the “Fan Status” level which will be immediately credited with any points in excess of those used to reach the new status;
  • If a “Friend Status” customer earns 1,300 points before they have acquired the “Fan” status, they move directly to “Lover Status”, which will be immediately credited with any points in excess of those used to reach the new status;
  • A year after acquiring the “Friend Status” level, and every year after that, the Customer:
    • - if he/she has earned between 200 and 299 points, maintains “Friend Status" level for another year and any points in excess of those used to keep this status shall be maintained;
    • - if he/she has earned less than 200 points, his/her points balance will be reset to zero and he/she will return to the “Follower Status” level.

“Fan Status”:

  • Customers acquire “Fan Status” as soon as they have earned 300 points since the previous “Friend Status”. The new status will be immediately credited with any points in excess of those used to move level;
  • Once they earn 1,000 points, “Fan status” Customers move to the “Lover Status” level which will be immediately credited with any points in excess of those used to reach the new status;
  • A year after reaching the “Fan Status” level, and every year after that, the Customer:
    • if he/she has earned at least 500 points, maintains “Fan Status" level for another year and any points in excess of those used to keep this status shall be maintained;
    • if he/she has earned less than 500 points, his/her points balance will be reset to zero and he/she will return to the “Friend Status” level.

“Lover Status”:

  • Customers reach “Lover Status” as soon as they have earned 1,000 points since the previous “Fan Status”. The new status will be immediately credited with any points in excess of those used to move level;
  • A year after reaching the “Lover Status” level, and every year after that, the Customer:
    • if he/she has earned at least 1,500 points, maintains “Lover Status" level for another year and any points in excess of those used to keep this status shall be maintained;
    • if he/she has earned less than 1,500 points, his/her points balance will be reset to zero and he/she will return to the “Fan Status” level.

Each change of status, as well as all communications concerning participation in the loyalty program, which are strictly indispensable for providing the services connected to it (for example, confirmation of subscription/cancellation, changes in status, special discount offers or exclusive gifts) are necessary for the operation of the program itself. Therefore, by accepting these rules, the Customer agrees to receive said communications, which will be sent to the addresses given on the program registration form. Refusal to receive said communications shall prevent CALZEDONIA Finanziaria S.A. Belgium Branch from implementing the program and providing the services associated with it. Any refusal expressed during the course of the program shall result in an automatic interruption of the program.

8. EARNING POINTS

Loyalty points shall be automatically loaded onto activated Cards when each purchase is made at one of the “Calzedonia” stores which take part in the promotion or via the e-commerce site www.calzedonia.com. One point will be given for each euro spent, rounded down (e.g. €1.99 = 1 point).
In order to have the points arising from the e-commerce purchases credited to the Card, Customers must previously register their Card number under their e-commerce account. The insertion of the Card number shall be done only once and, for subsequent purchases the system will automatically remember it.
In order to be entitled to points, Customers must identify themselves before the receipt is issued by presenting their Card or by giving their surname and name or the email address/telephone number used for card activation. In cases of online purchases, Customers must access the website by entering their details.
Should the Cardholder fail to provide identification in the manner specified above, then points will not be earned, and it will not be possible to have them credited subsequently.
Customers may check their points balance at any time by requesting it at any “Calzedonia” stores participating in the scheme or by consulting the website www.calzedonia.com. Points will be credited and recorded daily by the system; in the event of technical problems, they may be credited at a later point in time.
Returned items will result in points being debited according to the same criteria used for crediting points.
Issuance of a “Calzedonia Gift Card” will result in a credit of the corresponding number of points.
Subsequent purchases paid partially/entirely with a Gift Card will not, therefore, earn any points for the part of the purchase paid for using the Gift Card.
Promotions involving double or triple points may be organised and these will be advertised accordingly.
The Card is in not a method of payment; the points credited cannot be transferred or converted into cash or goods.

8.A EARNING POINT AND CROSS-COUNTRY BENEFITS

The Customer holding the “Calzedonia Lover” Card will collect points even through the purchase in points of sales located in the Territories listed below.
The above-mentioned collecting points will allow the points crediting to reach the status and using the prizes provided under these terms and conditions in The Netherlands.
The loyalty points will be credited on the Client’s “Calzedonia Lover” Card subject to the table below.
Only for purchases in Russia, the loyalty points will be credited subject to prior presentation of the Loyalty Card.

The Client holding the “Calzedonia Lover” Card who will purchase in points of sales located in the Territories above may take advantage, exclusively at the moment of the purchase and as additional benefit, from the discounts provided by each Country to that Client’s Status.

9. MANDATORY BENEFITS

Customers holding the Calzedonia Card can benefit from numerous discounts, promotions, prizes and special initiatives, which will be suitably advertised and communicated as the need arises.
Customers may benefit from the special advantages only by presenting their Card.
The discounts are as follows:

  • Free deliveries or returns on e-commerce purchases for all Status holders;
  • Upon subscription, the customer earns 20 points;
  • On their birthday and exclusively during the period between the 5 days before and 5 days following their birthday, Follower Status Customers shall be entitled to double points on purchases;
  • On their birthday and exclusively during the period between the 5 days before and 5 days following their birthday, Friend, Fan and Lover Status Customers shall be entitled to a 20% discount on a single purchase.
  • €20 discount coupon, valid for 60 days of its issue, on a minimum spend of 70 euros (with the exclusion of items already subject to discounts or promotions) for those belonging to the Friend, Fan and Lover Statuses;
  • 10% discount on all purchases after the Lover Status is obtained and for the entire period in which the Customer keeps this status, with the exclusion of items already subject to discounts or promotions.

10. Discontinuation of the scheme - card deactivation - miscellaneous

Calzedonia reserves the right to amend, suspend or discontinue the “Calzedonia Lover” Loyalty Program and related services at any time at its own discretion.
Customers shall be informed of these changes, suspensions interruptions on the www.calzedonia.com website or at the stores participating in the scheme. Without prejudice to any other right established under law, including the right to compensation for damages, Calzedonia Sverige AB shall be entitled to revoke Customer's right to use the Card and deactivate it in the event that the Card is used in breach of these Conditions or in the event of unlawful use or use that is harmful to the image of “Calzedonia" and its brand.
Furthermore, subject to giving notice, Calzedonia Sverige AB reserves the right to deactivate the Card and the associated activation/registration if the Card is not used, or the Customer remains inactive for a period exceeding 5 years. Revocation and deactivation shall result in the Customer no longer being able to benefit from the advantages and services offered by the “Calzedonia Lover” Loyalty Program.
Calzedonia Sverige AB is not responsible for any direct or indirect consequences related to problems with the “Calzedonia Lover” Loyalty Program for reasons that are beyond its control.
Calzedonia Sverige AB is not responsible for any fraudulent, improper or incorrect use of the Card.

11. Personal data protection, privacy Notice

The Calzedonia Group companies care about privacy and the protection of personal data. We hereby wish to inform you about how we process your personal data following the registration to the “Calzedonia Lover” Loyalty Program.

Which categories of personal data will we use?

In particular, we need to process the personal data provided to us at the time of registration (failure to provide the data marked with an asterisk involves the inability to complete the registration process, in case of registration carried out in each point of sale with the support of the sales assistants, the phone number or email address are mandatory data. Failure to provide these data involves the inability to complete the registration process) and the data relating to purchases made at points of sale Calzedonia. These data include, for example, the price and type of products purchased. With your consent, we may also use other information that you freely provide to us at the time of registration or concerning the manner in which you interact with us (hereinafter, collectively, the "Data").

More precisely, we could collect:

  • optional information requested through the registration form or, in case of registration carried out in each point of sale name, surname, address ZIP code, country and province are optional information;
  • the information that we may acquire by examining your interaction with us, through email and newsletters, through our Internet sites and through the Apps that may be developed by us or by third parties (for more information, please consult the relevant privacy policies);
  • information that you may share through the social networks to which you subscribe.

For which purposes we do process your Data and on what legal grounds?

We may use your Data, including by electronic means:
a) for the management of your participation to the “Calzedonia Lover” Loyalty Program. Your Data will be used to provide you with discounts and other benefits, which may available to you and, more generally, for all related contractual and administrative obligations.

b) to provide you a personalized service in all our points of sale where the “Calzedonia Lover” loyalty program is active. Wherever you are, you could receive the help and advice of our sales assistants, with information (eg. for Calzedonia size, color or pattern) on items purchased in the previous 12 months at any point of sale Calzedonia or even online. Provided that Calzedonia is a global brand, such use of your Data, based on our legitimate interest, allows us to improve the quality of our services at the point of sale and to ensure a consistent service to our customers who have joined the “Calzedonia Lover” loyalty program in all our stores. In any case, if you do not wish to receive this assistance, it is sufficient that you, at the time of registration or even at a later time, ask that your Data not be used for this purpose

With your consent, we may also use your Data for the following purposes:
c) to send you, through the contact details provided to us, newsletters, information about products and services provided by us, offers and promotions, as well as to conduct market researches. For example, we may send you emails or text messages (eg. SMS e WhatsApp), send you promotional materials at your postal address or contact you by telephone via an operator. Our products are marketed under the following brands:
CALZEDONIA, INTIMISSIMI, TEZENIS, FALCONERI and SIGNORVINO.

d) to review your preferences, how you interact with us, and your purchasing behavior. In particular, in order to better understand your tastes and interest in our products and communications, we may examine - also through the use of automated systems – the information provided at the time of your registration to the “Calzedonia Lover” Loyalty Program, the purchases made at our Calzedonia points of sale in the last 12 months, your interest in communications and newsletters that we send you, the attendance of our websites, the use of our Apps and the interest in our social channels (e.g. Facebook). For further information on the Data that we may acquire through browsing our websites and/or through the use of our Apps, you may consult the relevant privacy policies. Finally, we may enrich your profile with statistical information that we may lawfully acquire from other sources: for example, in relation to your area of residence (such as demographic information, geo-referencing data, etc.) or to the electronic tools that you use to interact with us. In any case, this profiling activity is aimed at better personalizing our services and does not have any legal or other significant effect on you.
Your subscription to the “Calzedonia Lover” Loyalty Program is in no way conditional upon the provision of the above consents.

How long do we store your Data for?

Your Data will not be processed for longer than the time required to manage your participation to the “Calzedonia Lover” Loyalty Program. In any case, information about your purchases and your interactions with us will not be processed for longer than 12 months from the date of collection. In the event that you decide to leave the “Calzedonia Lover” Loyalty Program your Data will be deleted within the following 3 months.

To whom will we communicate your Data

For the purposes of the management of the “Calzedonia Lover” Loyalty Program and for administrative purposes, we may communicate your Data to our service providers (e.g. IT services) and to the companies that manage the Calzedonia points of sale, present in the various countries where the “Calzedonia Lover” Loyalty Program is active, who will be acting as data processors, and to other third parties where there is a legal obligation to do so. A complete list of such companies will be made available by sending a written request to the following contacts.

How will the transfer of your Data to non-EU countries be regulated?

Your Data may be transferred outside the territory of the European Union, even to countries where the level of protection of personal data may be lower than that guaranteed by European legislation. Such transfer shall, in any case, be subject to adequate safeguards for the protection of your Data and, in particular, to the standard contractual clauses approved by the EU Commission by Decision 2010/87/EC.

What rights do you have over your Data?

You have the rights of access, rectification, erasure, limitation of and opposition to the use of the Data by us, as well as the right to request the transfer to you of some of the Data.

Right of access
The data subject has the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information:
a) The purpose of processing;
b) The categories of personal data concerned;
